Much as Apple and Samsung were ordered last month to hold settlement talks, the U.S. District Court of Delaware has asked that Apple and HTC try to come up with a settlement in their legal battle. Both parties will have their lawyers and unspecified decision makers meet on August 28th for discussions. The talks will be moderated by Magistrate Judge Sherry R. Fallon.

The order comes a day after U.S Customs blocked imports of the HTC One X and HTC EVO 4G LTE as a result of a U.S. International Trade Commission ruling.

It’s not clear who will represent the two companies at the talks but they “must have full authority to act on behalf of the parties, including the authority to negotiate a resolution of the matter and to respond to developments during the mediation process.” The court also expects that both sides will show “full and good faith cooperation with the mediation process.”

HTC holds the dubious honour of being the first Android device manufacturer to be sued by Apple, way back in March 2010.

HTCThe launch of the HTC EVO 4G LTE will likely occur later than HTC and Sprint had planned as the smartphone is facing import delays imposed by U.S. Customs. The HTC One X is facing similar delays and will likely become difficult to find at AT&T stores. The holds are due to an unresolved patent infringement issue with Apple. HTC confirmed the delays in a short statement:

The US availability of the HTC One X and HTC EVO 4G LTE has been delayed due to a standard U.S. Customs review of shipments that is required after an ITC exclusion order. We believe we are in compliance with the ruling and HTC is working closely with Customs to secure approval. The HTC One X and HTC Evo 4G LTE have been received enthusiastically by customers and we appreciate their patience as we work to get these products into their hands as soon as possible.

In December, the ITC ruled in favour of Apple for one patent infringement and imposed an importation ban on some of HTC’s devices. The ban took take effect on April 19th. At the time, HTC described the ’647 patent as “a small UI experience” and planned to remove it from all phones.

It is likely that HTC will try to stay the ban as part of an appeal. For now, it remains unclear if and when U.S. Customs will allow imports of these devices to resume.

HTC One XA “very small number” of HTC One X smartphones suffer from a messaging issue whereby incoming message notifications don’t work. Both status bar notifications and icon notifications are affected, leaving users to having to open the app to see the new messages.

Not only does the issue only some devices but it also appears to be random. The incoming message notification may work sometimes and not some other times.

HTC has confirmed the issue and is already working on a fix. There is no ETA as to when it will be pushed out but HTC expects it to be “as soon as possible.”

HTCThe 3D experiment appears to have come to an end at HTC. Jeff Gordon, Global Online Communications Manager for HTC, today told CNet that “we don’t have any new products with 3D in the lineup. That’s based partially on customer feedback, what we know the market wants, and also a design decision we’ve made.” At the same time, Gordon left the door open for its eventual return.

The upcoming HTC Evo 4G LTE (scheduled for release on May 18th for US$199.99) was to have come with 3D capabilities but Sprint opted against it and asked that it come with a kickstand instead.

HTC’s first 3D smartphone was the HTC Evo 3D which launched last year.

Verizon WirelessIt would appear that some exciting devices are in store at Verizon later this year. BGR has allegedly obtained the carrier’s smartphone roadmap for the summer and fall seasons.

While Verizon passed on the Samsung Galaxy S II, it does plan to offer the upcoming Galaxy S III. No timelines are provided but a summer launch is likely.

Verizon also has a number of new Motorola RAZR devices coming (as new DROIDs?). Details are slim but a successor to the original RAZR, possibly known as the RAZR HD, could sport a larger and clearer display. There are no details on the other RAZRs.

A new flagship HTC device is also in the works. This new device could sport a quad-core Snapdragon S4 processor with Adreno 320 GPU, a 5-inch 1080p HD non-Pentile display, HTC Sense 5 and a Scribe pen. It looks like Huawei is not the only competitor Samsung will have in the phablet space.

HTCIt appears that HTC is working with Facebook to develop a new “customized smartphone.” Citing its usual “industry sources,” Digitimes expects that the device could launch as early as Q3 2012. The seeds for this HTC-Facebook partnership may have been planted with last year’s HTC ChaCha and HTC Salsa.

The report adds that this smartphone will be powered by Android and come with “a platform exclusive to Facebook to enable and integrate all functions available on the social networking site.” This could mean that the dedicated Facebook button seen on the HTC ChaCha and HTC Salsa will reappear along with deeper integration into the Android platform (widgets, user interface customization, etc).

Facebook will go public in the near future. Own-brand smartphones could be part of its development strategy as it looks to grow revenues by expanding into new areas of business.
